Workplace Departures in California: Organizing a Timeline for Independent Review

Three record questions
Separating Event, Explanation and Source
What happened? Describe the employment action and its date without assuming motive.
What explanation was given? Distinguish the stated reason from any competing account or inference.
What supports the account? Identify documents, direct observations and points that remain uncertain.

Different treatment
Reading a Discrimination Question After a Firing
CRD employment guidance explains prohibited discrimination based on protected characteristics and the employment practices it covers. Whether a particular termination involved such discrimination depends on the facts and applicable coverage; this page does not make that finding.[7]
A factual account may identify:
- The role and circumstances of a replacement, if known
- Comparable work decisions and the basis for comparison
- Statements relevant to the concern and who heard them
- The history and dates of performance information
A report and response
Reading a Possible Retaliation Question
The Labor Commissioner describes its retaliation complaint procedure. The relevant report or exercise of a right, the later action and their connection are separate parts of an account. Read the procedure before assuming its coverage.[5] Describe the activity being discussed and the source for that description, such as:
- A harassment or discrimination report
- A payment concern or agency filing
- A leave or accommodation request
- A report concerning an asserted violation
- Participation in a workplace investigation
This list does not establish that every activity is protected by the same rule. A sequence of events, including a short gap, is not by itself a conclusion that retaliation occurred.
A resignation account
Questions About a Disputed Resignation
A resignation described as following intolerable conditions raises an individual question about the circumstances. This guide does not apply a constructive-discharge standard or tell a reader to resign. It organizes the changes, communications and reason for leaving that may require assessment.
Use the separate resignation guide as a reading aid, not as a calculation of the likelihood of success or the consequences of leaving.
